THE QUICK ANSWER
Identify the legal seller, destination country and sales route, then obtain packaging-only material and weight records. The Council’s 21 October 2026 proposal concerns limited representative relief; it is not an enacted exemption from packaging EPR.
1. Separate the current rule from the October proposal
Extended producer responsibility (EPR) concerns the waste-stage obligations of the legally defined producer. The Council’s 21 October 2026 mandate would allow certain EU-established packaging producers to avoid appointing an authorised representative in another Member State when they make less than one tonne of packaging available there per calendar year. Negotiations with Parliament are the next step. The mandate concerns representation and includes conditions; it does not announce the end of EPR. A small pet brand should keep complying with current requirements while checking for a final adopted text. Record the source date and legal stage on the compliance file so a news headline cannot silently become an instruction to stop registration or fee payments.

2. Draw the sales route before naming the producer
Start a route record with the contracting legal entities, who owns the brand, where each entity is established, who imports and where the goods are first made available. Add whether the customer is a retailer or an end user. A Chinese OEM shipment to an EU importer, an EU brand selling domestically and an online seller shipping directly across borders require different role checks. Do not assign the obligation simply to the party that physically folds the box. Ask the competent authority or scheme to confirm the role for your route, and retain the reply with the commercial documents.
3. Confirm the destination-specific position
The Commission’s small-business guidance says existing national EPR registration rules must still be followed where packaging is likely to become waste. It describes possible small-producer flexibilities, not a universal zero-obligation threshold. Use a country row for each destination and record the responsible entity, applicable register or scheme, representation question and next reporting action. Ask which simplifications are actually available rather than assuming that a low product MOQ qualifies. Product pieces, packaging mass and company size measure different things. Keep a dated answer for each country; one registration number should not be treated as proof of coverage for every market.

4. Obtain the packaging bill of materials from the approved pack
Ask for each packaging component, its material group, mass per unit, quantity per sale unit or carton and the artwork or pack revision. Identify hang tags, sleeves, bags, inserts and shared transport packaging so their treatment can be confirmed under the applicable reporting rules. Gross carton weight includes product and cannot replace packaging-only records. Germany’s Central Agency Packaging Register specifically asks own-brand retailers and importers to obtain packaging weights and material groups from suppliers and keep a logical paper trail. Its guidance is German implementation context, not a substitute for checking every other destination.
5. Use Catidog product details to identify the pack boundaries
Three published references show why the packaging record must follow the actual item. Our leash reference uses a woven label sewn into the handle keeper; the steel-bowl reference uses laser marking on the base; the washable-bed reference uses a woven seam label and printed care label. These are product branding details, not a measured packaging inventory. Each reference also allows custom packaging whose format, material, dimensions and barcode position are agreed per order. Ask us to distinguish attached product labels from separate hang tags, sleeves and cartons in your pack specification. No published packaging mass, EPR fee or registration service is implied by these customization options.
6. Reconcile the record when the pack or sales route changes
Freeze one packaging version before calculating volumes. For each component, mass per unit multiplied by the relevant number of units gives a planning mass; use the destination scheme’s rules for aggregation, units, exclusions and actual reporting. Recheck the file when a retail box replaces a sleeve, a fulfilment centre adds packaging or the seller enters another country. Retain the underlying measurement and order allocation rather than only a total in a spreadsheet. Ask who will update the record and who approves a revision. This is a purchasing control, not a claim that every packaging component belongs to the same reporting category.
Scope and the next purchasing action
This checklist is for non-food pet-accessory packaging and does not classify pet food, batteries, electrical equipment or textile EPR streams. Packaging design conformity, product safety, waste reporting and environmental claims are separate checks. The Packaging and Packaging Waste Regulation (PPWR) began applying on 12 August 2026, with requirements phased over time; that does not make every future design or labelling requirement immediately applicable. Before the next order, send your destination markets, sales route and proposed pack. We can review the packaging requirements and confirm what documentation is available for the selected order. Registration decisions and scheme fees should be confirmed with the relevant authority or adviser.

Questions buyers ask
Does an order below 100 pieces avoid packaging EPR?
Do not use product quantity as an exemption test. The responsible entity, destination rules, packaging mass and sales route matter. Confirm any relief with the destination authority or scheme.
Has the Council removed the representative requirement?
No. Its 21 October 2026 announcement is a negotiating position for a limited suspension. Check the final adopted law and current national position before changing your arrangements.
Can the OEM factory simply take over our EPR obligations?
Do not assume that a service agreement changes the legal producer. Confirm the role by sales route. Germany’s regulator expressly distinguishes own-brand retailer responsibility from the physical supplier or contract packager.
Is master-carton gross weight enough?
No. Gross weight includes the goods. Request packaging-only component weights and counts, then confirm the applicable reporting categories and calculation rules.
What packaging information can I request with an RFQ?
Include destination markets, the proposed retail pack and your required material and weight records in Project details. We will review the requirements and confirm the documentation and packaging scope for the order.
